Terms and Conditions
- MMT has put in place a program called “MySafety” (“the Program”) covering safety and hygiene practices adopted by the hotels listed on MMT portal (“Participating Hotels”). The Program has been developed based on the leading industry practices. As part of the Program, certain standards and procedures (“Standards”) need to be followed by the Participating Hotels in order to continue to be classified as “MySafety – Safe and Hygienic Stays” (“Classification”). The Participating Hotels have formally entered into an agreement to implement the Program and are responsible to ensure adherence to the same.
- MMT has put in necessary systems/processes to oversee this Program and its implementation and compliance across the Participating Hotels. As a part of the above-mentioned process, MMT has engaged an independent professional firm of a global repute (“Independent Firm”) to carry out a check at the Participating Hotels once in 90 days and report status, based on the visual observations, on compliance as per a predefined checklist to assist MMT in reviewing adherence to certain elements/aspects of the Program. The Independent Firm is not involved in the design or review of the Program or for checking or validating the completeness, adequacy and accuracy of the Program or the checklist. The Independent Firm will rely upon the information, representations and explanations provided by Participating Hotels, in carrying out its surprise checks.
- The Standards are an assurance claim by every Participating Hotel for the safety and hygiene practices it follows. The Classification of Participating Hotels is done at the sole request of the Participating Hotels pursuant to the successful review of its compliance with the Standards.
- MMT will display the Standards and Classification on the MMT portal against the listing of the Participating Hotels successfully completing the review.
- Notwithstanding anything to the contrary, the responsibility of:
- Complying with the Standards will remain solely with the Participating Hotel. Neither MMT nor Independent Firm assume any responsibility or liability to ensure adherence of the Standards by the Participating Hotel;
- Carrying out the review will remain solely with the Independent Firm. MMT does not assume any responsibility or liability in the conduct or outcome of the review. MMT will not verify the contents or accuracy of any observations shared by Independent Firm.
- If the customer is not satisfied with the Standards maintained by the Participating Hotel and if he believes that the Participating Hotel isn’t complying with the Standards, then the customer should raise a complaint directly with the Participating Hotel and seek redressal from the Participating Hotel only. MMT/ Independent Firm will not be liable to compensate the customer in any of the situations as mentioned above.
- MMT has the right to, without any obligation of issuing prior notice to the Participating Hotel or to the customer:
- Remove the Classification for a Participating Hotel if MMT has reasons to believe that the Participating Hotel doesn’t meet the Standards in letter and spirit, or at the request of Participating Hotel, or at the discretion of MMT without assigning any reasons thereof;
- Change the terms of the Standards to make them best suitable and relevant for the needs of the customers, or to meet any legal requirements;
- Suspend or cease any such classification of Hotels on the basis of the Standards.
- The terms of the User Agreement and the Privacy Policy will continue to apply in addition to the Standards.
- MMT/Independent Firm shall not be liable for any indirect, consequential, or incidental losses incurred by the customer who have made a booking placing reliance on the Classification. As explained above, the recourse of the customer will lie only with the Participating Hotel.
- MMT shall not be liable for any loss or damage due to any force majeure events or reasons beyond the reasonable control of MMT, respectively.
- The maximum liability of MMT in any situation whatsoever will be limited to refunding the booking amount as paid by the customer.
- Any disputes on these terms shall be subject to the exclusive jurisdiction of the courts in New Delhi.
