MakeMyTrip India Pvt. Ltd. offers visa assistance services subject to these terms and conditions. If you agree to obtain such services, you shall be assumed to have agreed to these terms and conditions. These terms and conditions should be read as part and parcel of the user agreement available at https://www.makemytrip.com/legal/in/eng/user_agreement.html.
1. Scope of Service: The service includes gathering user information/documents, scheduling appointments and submitting visa applications to the relevant consulate, embassy or visa application center on user’s behalf. Information is collected on the basis of checklists provided by the embassy/processor and/or market practices generally followed in this regard. The grant of visa, time taken to process visa and the documents required in each case are at the absolute discretion of the concerned embassy and we do not guarantee that your visa shall be granted or that the advice provided by us will always be accurate. Please note that you are responsible for determining what visas are required for your travel. We do not advise on applicability/ requirement of visa for any particular travel.
2. Your Obligations: You are advised to ensure that all information you provide is accurate, and consistent with the purpose for which it is provided. While we may provide advise based on our experience in submitting visa applications, in case of any doubts, you must also check all information with the relevant embassy or consulate directly. You must review your application prior to submission and ensure that all information provided is accurate, up to date and relevant for the purpose for which it is submitted. We shall not be liable for any errors or omissions in your application. You agree that we, and third parties we work with, are authorized to submit the visa application and accompanying documents on your behalf and make submissions to relevant authorities on your behalf.
3. Fees and Payments: We charge a fee for visa assistance services which are transparently communicated prior to accepting any order. Additional third party charges fees such as visa fee, embassy chares, logistic charges (courier charges/charges for picking up and delivery of documents) and/or any other fee/charges that may be levied by relevant government authorities including taxes may also be additionally applicable. You must make payment of the indicated fees and charges before we commence services, and make payment of any identified additional third party charges as and when indicated. We reserve the right to revise our service fees at any time, provided that revisions in our service fee shall not affect orders already under process. Third party charges are subject to change at any time. We reserve the right to charge the difference between any third party charges that may have been collected from you and those that may actually be incurred. Our service charges are non refundable. Any third party charges that have been paid to us but not been incurred may be refunded upon request.
4. Visa Processing Times: Processing time for visas, if quoted by us, are tentative and based on processing times provided by relevant embassy or consulates under normal circumstances and/or based on our experience. Such advise is provided on a best effort basis without any assurance or guarantee of its accuracy. Please note that visa processing timelines vary, depending on the country, visa type, individual circumstances, documents submitted etc..
5. Appointment Scheduling: Where possible and feasible, we will assist you in scheduling appointments with embassies, consulates or visa application center. We cannot guarantee the availability of appointments or the place of appointment. You are responsible for attending the appointments on time and for complying with all embassy or consulate requirements. You must provide all necessary information for appointment scheduling. Where you request us to do so, we will use reasonable efforts to reschedule your appointment date, subject to availability.
6. Visa Delay/Rejection/Correction: We shall not be responsible for the actions of any consulate, embassy or any other Issuing Authority in delaying or rejecting visa applications for any reason whatsoever, or for issuance of visa with incorrect details. We shall not be liable for any losses, consequential or other damages, costs, expenses or losses of income/profits or loss of travel or holiday costs (whether purchased from us or any other travel intermediary or any other loss be it financial, physical or mental that you may incur directly or indirectly, due to delays or non-issuance of visa, for whatsoever reason.
7. Appeals: Should you wish to appeal a visa rejection or explore alternative options, we shall, where feasible and/or possible, act strictly pursuant to your express instructions, and subject to such charges as may be applicable.
8. Data Privacy and Security: we collect and process personal information in accordance with applicable data privacy laws in India. You hereby permit us to utilize your personal information to provide the services, and to share personal information with third-party service providers who assist us in delivering the services. 9. Document delivery: Visa deliveries via post/courier are subject to the conditions set by third-party delivery companies. We shall not be liable for losses or delays incurred due to acts/omissions on part of third-party delivery partners. Upon return, please immediately confirm that the documents are in order, that all of the visas you need for your travel have been obtained, that the visas for each country you intend to visit are valid for the dates of arrival and departure from the country of your visit and for the purpose and nature of your visit.
10. Dispute Resolution: Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
11. Force Majeure: We shall not be held responsible for any delay or failure arising from or is in connection with an act of god or other event which is beyond our reasonable control, including without limitation war, hostilities, civil commotion, strikes, lockouts, pandemics, natural calamities, industrial disputes or laws, governmental regulations/notifications.
